Fab Terms of Service



The purpose of Fab is to provide high-quality content to developers for their commercial projects or educational purposes, and it is the aim of these guidelines to make obtaining and distributing great content easy and beneficial for everyone.



The web pages available at fab.com and linked pages ("Fab") are accessed by you ("you" or the "user") under the Terms of Use described below ("Terms").



If your primary residence (or primary place of business, if you are a legal entity like a corporation or an academic institution) is in the United States of America, your relation is with Epic Games, Inc. If it is not in the United States of America, your relation is with Epic Games Commerce GmbH. In these terms "we" or "us" or "Epic" refer to either Epic Games, Inc. or Epic Games Commerce GmbH, depending on the location of your primary residence or primary place of business.



Services we provide on Fab.com or via any official Fab plugin, are collectively the "Services". Epic may use third parties to provide some or all of the Services. The Services may be provided using servers and other equipment located in any country including the United States and elsewhere.



Please read these Terms carefully before using the Services. By accessing the site, viewing any content or using any services available on the site you are agreeing to be bound by these Terms. If you disagree with any part of the Terms, please do not access the site.



Apart from following these Terms, please make sure you are familiar with and respect the rules set up in:



Epic Games Terms of Service - which regulate the use of Epic services in general,



Fab End User License Agreement (i.e., Fab EULA) - which is a legal agreement between a Fab user and a Fab Content Licensor and regulates how the Fab content can be used,



Epic Games Content Guidelines - which regulate what content is not allowed within the Epic ecosystem,



Our Community Rules - where you can find a guide on how you should interact when inside the Epic ecosystem and what is not allowed here,



Fab Refund Policy - which sets up rules for product refunds,



If you are a seller, the Fab Distribution Agreement - which outlines your legal rights and obligations related to distribution of content on Fab.

GENERAL



The Terms in this section apply to all file types that Fab accepts and apply to all users of the Services, including logged-in and not-logged-in visitors of Fab.com, Fab's UEFN and UE plugins users ("customers"), and those listing their products on Fab ("publishers").



You are required to follow Our Rules when interacting on Fab.



Purchasing or claiming a free product through Fab grants the customer usage rights regulated by the Fab EULA. Distribution of products via Fab is not a sale of the content but the granting of digital rights to the customer.



Epic allows third party publishers to distribute their products through Fab. Some of the products available on Fab are made available by Epic while some are offered by third party publishers. Information about the content provider is made available on the product page.



Violation of these guidelines may result in actions against an account, including, but not limited to, removal of products, suspension, or termination of publisher/customer accounts. In case of users with multiple accounts Epic reserves the right to take action against all accounts owned or controlled by the user.



From time to time we may modify these Terms by posting the modifications on Fab. You will be bound by the modified terms after the modified terms have been emailed to you or have been posted on Fab for 30 days.



Use of Fab



You may only use the Services for your own purposes, and you must not resell, transfer or otherwise provide any of the Services to any third party.



You are solely responsible and liable for all activity conducted through your account. If you become aware of or reasonably suspect any security breach, including any loss, theft or unauthorized disclosure or use of your password, please follow these steps.



Fab should be accessed through the interfaces that are provided or approved by Epic, unless you have been specifically allowed to do otherwise by us. You may not access the Services or the content hosted on Fab through automated means, including use of scripts, crawlers or similar technologies allowing automated systems or software to extract data from Fab, or equivalent manual process, for the purposes of monitoring, measuring, analyzing, copying, publishing, selling, distributing or otherwise making the Services and the hosted content available to others to use ("scraping").



You must not:



reverse engineer, de-compile, hack, disable, disrupt, interfere with, disassemble, copy, decrypt, reassemble, supplement, translate, adapt or enhance any of the material on Fab except as permitted under these Terms, Epic Games Terms of Service, Fab Distribution Agreement or Fab EULA.



create a link, name or label, or otherwise upload to or transmit from Fab any content, link or anything else that (if reproduced, published, transmitted or used) may: 



impersonate any person;



give rise to civil or other liability;



use the Services to do or attempt to do any of the following without Epic's prior written permission:



send bulk messages (including spam);



obtain an email address, user name or other information about a third party without their consent;



make unjustified complaints or false reports on Fab;



artificially inflate or alter ratings, views or statistics on Fab;



sell or transfer your account, or allow any third party to access or use it;



interfere with the Services or any third party's use of Fab or the Services;



authorize or encourage any third party to do any of the above.



Other services



If you use any other service or software provided by or through Fab or the Services, you must comply with all terms and conditions that are imposed upon your use of that service or software.



MODERATION AND RECOMMENDATIONS



Moderation and reporting infringing content and misconduct



To report content that is in violation of the Epic Games Content Guidelines, please use Fab's dedicated reporting functionalities on the product page.



Reports of copyright or trademark infringement should follow the guidelines outlined in the Reporting Copyright and Trademark Infringement page.



We do not undertake any obligation to monitor, pre-screen or review content posted by Fab users, but reserve the right to do so.



In case Epic is notified or otherwise becomes aware that content posted on Fab violates applicable laws or Epic's policies, Epic may make necessary changes to the content, demand that the publisher make such changes, remove, limit visibility or reclassify such content at Epic's sole discretion. This includes, but is not limited to, gruesome content, sexual content, hate speech and other content described in Epic Games Content Guidelines.

Content recommendations



Fab may suggest content to you to help improve your experience on the Services. We do not make any personalized recommendations for you on Fab - most of the content you see is either presented by publication date or hand-picked by our team. The "Related content" feature you can see while reviewing a product page, will show you the most popular assets from the same seller.



OTHER



Payments



You may pay Epic through the payment options made available on Fab. You must comply with the terms of all agreements between you and any third-party payment processors, and if you have any disputes regarding the processing of your payment you must deal directly with those third parties to resolve the disputes. If Epic allows you to pay Epic directly via credit card, then you authorize Epic to charge all amounts to the credit card number you provide to Epic. If your credit card payment is rejected or refused you will immediately pay Epic the amount due and provide Epic with an alternative credit card number for future payments. You represent and warrant to Epic that each credit card you use for payment to Epic either belongs to you, and you have the right to charge all such payments on the credit card(s).



Advertising



Some of the Services may contain advertisements and promotions. The format, type and content of the advertising and promotions may change from time to time. You must exercise caution when purchasing goods or services from any third party advertiser or brand that may be promoted on or linked to on Fab.



Artificial Intelligence



Recognizing the desire for transparency around usage of artificial intelligence technology we have set up the following toolset to manage artificial intelligence on Fab:



Fab allows publishers to mark their content as "NoAI". You may not use Content that is marked as "NoAI" (a) in datasets utilized by Generative AI Programs, (b) in the development of Generative AI Programs, or (c) as inputs to Generative AI Programs.



We require the publishers to mark their content as "CreatedWithAI" when it was created using Generative AI Programs.

You are not allowed to use the Services in any way to train machine learning tools or models or any other artificial intelligence technology.



Epic uses artificial intelligence and machine learning technologies in our Safety and Discovery Tools to make sure our Services and Epic's other products and services comply with our Epic Games Content Guidelines and Community Rules and to improve our search and recommendations. We use your content to improve how our Safety and Discovery Tools operate. These tools perform a wide range of safety workloads, like identifying dangerous and illegal content, fraud, spam, unauthorized automation, fake accounts, and content, users or interactions which might break our rules. In addition to safety, we may further classify your content to provide services like search, recommendations and content discovery.
As noted above in Section 3.5, Epic does not use publishers' Content and does not license it to third parties for use in datasets for, training of, or as inputs to Generative AI Programs.



Interruptions, errors and updates



Your use of Fab and the Services might be interrupted and may not be free of errors. Some of the content on Fab might be translated, and those translations may not be accurate or appropriate. The Services may be unavailable from time-to-time due to routine maintenance, upgrades, repairs, hardware/software malfunctions, power outages and other unforeseen circumstances.



From time to time, Epic may add new features to Fab and the Services, remove existing features or otherwise modify Fab and the Services (including their functionality, "look-and-feel", universal resource locators and software components).



Disputes with other users



You are solely responsible for resolving any disputes you may have with other Fab users. Epic may, but is not obligated to, assist you with this. Epic will have no liability whatsoever to you in connection with any such dispute, regardless of whether or not Epic assists you with that dispute.



Termination



You may terminate your Marketplace account at any time. Epic may terminate your Marketplace account if Epic reasonably believes you have violated the terms of this Agreement or other Agreements you have with Epic.
